Reese Witherspoon Arrested After Sassing the Cops in DUI Incident [MUGSHOT]
Actress Reese Witherspoon, 37, and her 42-year-old husband, talent agent Jim Toth, apparently kicked off their weekend early: He was arrested for DUI on Friday, April 12.
And Reese found herself in handcuffs too -- for running her Oscar-winning mouth at the cops.
According to Variety, the couple was pulled over early Friday morning in Atlanta (where Reese is shooting the indie drama 'The Good Lie') when police noticed Jim weaving into oncoming traffic.
As cops administered field sobriety tests to Toth in a parking lot, Reese -- still in the car -- gave the officers lip.
Bad move. (Shouldn't her inner Elle Woods have warned against this?)
According to the police report:
“Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer ... I told Mrs. Witherspoon to sit on her butt and be quiet.”
Once her husband was arrested, Reese got out of the car, and when she was instructed to get back in, she “stated that she was a ‘US citizen’ and that she was allowed to ‘stand on American ground.’”
Having had enough, the cops decided to arrest her too, but Reese resisted, even though Jim tried to get her to calm down.
More from the police report:
“Mrs. Witherspoon asked, 'Do you know my name?' I answered, 'No, I don’t need to know your name.' I then added, 'right now.' Mrs. Witherspoon stated, 'You’re about to find out who I am.'"
“Mrs. Witherspoon also stated, ‘You are going to be on national news.’ I advised Mrs. Witherspoon that was fine.”
Toth was charged with DUI and "failure to maintain a lane while driving." Witherspoon earned herself a "disorderly conduct (obstruction)" charge.
The couple was released on bond at about 3:30 a.m. on Friday, and although they have a court date scheduled for Monday at 8 a.m., they aren't expected to appear and their attorney will likely ask for a postponement.
Jim and Reese have been married since March of 2011. She gave birth to their son Tennessee in September of 2012.
