Katy Perry perhaps took a page from her frenemy Taylor Swift's book and attempted to trademark the iconic Left Shark from her 2015 Super Bowl performance — only to be denied.

According to the BBC, Katy's company filed legal papers in an attempt to trademark the design in order to stop people from making a profit from unlicensed designs, but the request was thrown out by "trademark examiner" David Collier.

The Left Shark design, Collier explained, "identifies only a particular character; it does not function as a service mark to identify and distinguish applicant's services from those of others and to indicate the source of applicant's services." Collier reportedly also noted that the drawing submitted did not match the Left Shark design.

The trademark attempt occurred after Katy Perry's lawyers sent a cease and desist letter to a man who was selling 3D-printed models of the costume.

WENN reports that Katy Perry is also attempting to trademark the phrases, "left shark," "right shark," "drunk shark" and "basking shark," but this paperwork is still being processed. She can apparently submit the design application again.
